摘 要： 立法理念蕴含着立法的价值与功能定位，也将影响法律的实施效果。从国家治理现代化视角加以审视，修订后的新《档案法》在立法理念上发生了转变，突出表现为五个方面：“依法治档”与“依宪治国”相统一；从“档案权力”走向“档案权利”；从“档案法制”走向“档案法治”；从“行政主导”走向“多元共治”；从“有法可依”走向“良法善治”。基于此，新《档案法》将为国家各地区各部门各单位涉及档案事务的有关调整、治理、协调提供重要法治保障。其贯彻实施，能进一步增强档案工作的国家责任，确保为推进国家治理现代化提供更有效的档案服务。

Abstract: The concept of legislation contains the value and function orientation of legislation, and will affect the implementation effect of legislation. Inspected from the perspective of national governance modernization, the revised newArchives Lawcan be found to have undergone changes in legislative concepts, which is prominently manifested in five aspects: the unity of “administering archives by the law” and “administering the country by the Constitution”; from “Archive Power” to “Archive Rights”; from “Archival Legal System” to “Archival Law Governance ”; from “Administratively Leading” to “Multiple Co-governance”; from “Laws to Follow” to “Good Law and Good Governance”. The newArchives Lawwill provide important legal guarantees for the adjustment, governance, and coordination of archives affairs related to all departments and units of the country. Its implementation can further enhance the national responsibility of archival work and ensure that more effective archives services can be provided to promote the modernization of national governance.
